Can Students Bring Their Family to the UK Under the Points-Based System?

Bringing family members to the UK while studying is possible in limited circumstances under the UK’s Points-Based Immigration System. However, dependent eligibility rules have changed significantly in recent years, and not all students can sponsor family members.

This guide outlines who can bring dependants, which family members qualify, and key visa considerations.

Who Can Bring Dependants to the UK?

Under current UK immigration rules, most international students cannot bring dependents unless they meet specific criteria.

You may be eligible to bring dependants only if:

  • You are enrolled in a postgraduate research programme (such as a PhD or other doctorate-level qualification), OR
  • You are financially sponsored by a government for a course lasting longer than six months.

Students studying undergraduate courses, taught master’s programmes, diplomas, or foundation programmes are generally not permitted to bring dependants under the current regulations.

Eligibility is assessed by UK Visas and Immigration under the UK Points-Based System.

Who Qualifies as a Dependant?

Only the following family members may apply as student dependants:

1. Partner

A partner may be:

  • A legally married husband or wife
  • A civil partner
  • An unmarried or same-sex partner (you must prove you have lived together in a relationship similar to marriage or civil partnership for at least two years)

Additional requirements:

  • The partner must be at least 18 years old at the time of travel
  • You must intend to live together during your studies
  • Your partner must intend to leave the UK when your visa expires

2. Children

Children must:

  • Be under 18 years old at the time of application, OR
  • Be 18 or over only if they already hold valid dependant immigration permission in the UK

In most cases, both parents are expected to be lawfully present in the UK. If only one parent is applying with the child, strong evidence must be provided showing:

  • Sole responsibility for the child’s upbringing, OR
  • Serious and compelling family circumstances, OR
  • That the other parent is deceased or not involved

UK immigration authorities apply strict scrutiny in cases where only one parent accompanies a child.

Can a Student Bring Children if the Other Parent Remains Overseas?

The Immigration Rules generally expect both parents to be in the UK unless exceptional circumstances apply.

Applications may only succeed if:

  • The student is the sole surviving parent, OR
  • The student has sole parental responsibility, OR
  • There are serious or compelling reasons supported by strong evidence

Each case is assessed individually, and documentation requirements are substantial.

Does a Baby Born in the UK Need a Visa?

A baby born in the UK does not automatically receive British citizenship.

A visa is not required immediately unless:

  • The baby intends to leave and re-enter the UK

However, a visa application is strongly recommended as soon as possible after birth.

Regarding healthcare:

  • A newborn is entitled to limited NHS secondary healthcare access for the first three months
  • After three months, access to NHS secondary care requires valid immigration permission and payment of the Immigration Health Surcharge

Submitting a dependant visa application allows payment of the health surcharge, ensuring continued NHS access.

Can Relatives Visit Instead?

If family members do not qualify as dependants, they may apply for a Standard Visitor visa to visit the UK for up to six months.

However:

  • Visitors cannot switch to a student dependant visa from inside the UK
  • They must leave the UK and apply from their home country if they later qualify as dependants

Anyone intending to stay longer than six months must meet full dependant visa requirements before travelling.

Can Someone Switch to Become a Student Dependant from Inside the UK?

Switching is possible in limited situations.

An applicant may switch into the Student Dependant category if they:

  • Currently hold another Points-Based dependant visa, OR
  • Previously held Student Dependant permission

Switching is not permitted if the person currently holds:

  • Visitor visa
  • Short-term student visa
  • Parent of a child student visa
  • Temporary admission status

In cases where switching is not permitted, the applicant must return to their home country and apply for entry clearance as a dependant.

Important Compliance Note

Immigration regulations and university policies are subject to change. Applicants must always refer to the latest official guidance from UK Visas and Immigration and the UK Government website before submitting an application.

Key Considerations Before Applying

  • Dependants must meet financial maintenance requirements
  • Visa fees and Immigration Health Surcharge payments apply per dependant
  • Dependants may have work rights, subject to visa conditions
  • Applications are assessed individually, and supporting documents are critical

Students are advised to seek updated, official guidance before making any immigration decisions.
